Copyrights, Contracts, & Guidelines for Dinosaur Artists & Paleontologists

Part 2 Contracts
The Letter Contract Sometimes, when an artist has a long-established relationship with a company, or has negotiated a preliminary verbal agreement after a number of phone consultations with the client - it may seem too intimidating to the client to follow-up with a fully drafted contract. Something a little more informal is appropriate in these cases. That is when a letter signed by both parties can be used.

In this letter, the artist outlines all the points covered in the understanding he/she has with the client, making sure to include disposition of the original, copyright licensing limitations and terms, payment schedule, due dates, “kill” fees, and anything else from the list of things included in more formal contracts which should be mentioned in this one, and closes the description of his understanding like this:

“If the above description conforms to your understanding of our agreement, please sign and make this a binding contract between us.”

Then the artist signs the letter in the usual way, leaving a space below his/her signature for the client’s signature like so:

   AGREED TO
   ________________________________
   for The Medici Dinosaur Company

Two copies are then sent to the other party with the instructions to sign both and send one back to the artist. Faxing a copy for immediate signature can also be done, and insures, in cases where time is short, that work can commence immediately.
